I stole a cell phone and broke it afterwards. Can I still go to jail if I dont pay him back ?

I stole a cell phone due to personal reasons then a day later I broke it and threw it in a dumpster. He threatened to call the cops if I dont pay him back. Is that possible?

Keep in mind, he’s using a different phone because the one I stole was his ex-girlfriends phone under a different number BUT he used to have that phone (The one I stole). Well anyway I told him that he can get a 50 dollar replacable fee for an LG Rumor 2 but he told me he canceled the phones plan so he wants a total brand new one but Im thinking can he just get the replacable fee then switch the his phone number back onto the one I stole?

Calling the cops well after he tried to get money from you is a dumb thing on his part. He should have called the cops the moment he realized you stole the phone. A little late for that now.

If he wants, he can take you to court and try to prove you stole the phone to get money from you, probably the amount it takes to replace the phone, maybe more. He can show whatever paperwork he wants to show the cost on a new phone and also have a witness so you’ll probably get screwed. I would just pay him what the wants. I mean, after all, you DID steal and then break something that did not belong to you. Unless you don’t believe in karma, then continue being the irresponsible person you are.
